Terms of Service
These terms govern your use of TGIF Panda — the anonymous employee-feedback app and the employer dashboard. Please read them before using the Service.
Effective June 18, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Panda ECS LLC. (“Panda ECS,” “we,” “us,” or “our”) governing your use of TGIF Panda — our anonymous employee-feedback platform, including the mobile app for employees and the web dashboard for employers (together, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 16 years old and a member of a workforce that has been invited to use TGIF Panda by an employer. If you use the Service on behalf of an organization (for example, as an administrator), you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.
2. What the Service does
TGIF Panda lets employees share workplace feedback anonymously and gives employers aggregated, anonymized insights. The Service is designed to keep individual feedback anonymous — employers see combined results and anonymized quotes, not the identity of any individual respondent. The Service is a workplace-feedback tool only; it is not medical, clinical, legal, or human-resources advice, and it is not a substitute for professional judgment or for required workplace reporting channels.
3. Accounts and access codes
- Employees join a workplace using a facility access code. Keep your access code within your workplace; it connects a device to a facility.
- Employer administrators register an account with a work email address. You are responsible for keeping your credentials confidential and for activity under your account, and you agree to provide accurate information and keep it current.
4. Anonymous feedback
The Service is built so that feedback is not linked to your identity. To help keep it that way, do not include identifying information — your own name, a coworker’s name, or other personal details — in free-text feedback. You are responsible for the content you submit and must not submit anything unlawful, harassing, defamatory, or that violates another person’s rights or privacy. We may process submitted feedback to generate aggregated results and to operate, secure, and improve the Service, as described in the Privacy Policy.
5. Acceptable use
You agree not to:
- attempt to identify, re-identify, or de-anonymize any individual respondent;
- use the Service to retaliate against, intimidate, or harass anyone;
- submit false, automated, or duplicate feedback, or otherwise manipulate results;
- reverse engineer, decompile, scrape, or interfere with the Service or its security;
- access the Service other than through the interfaces we provide; or
- use the Service in violation of any applicable law or regulation.
6. Employer responsibilities
If you are an employer using the Service, you additionally agree that you will:
- use the Service lawfully and in compliance with applicable employment and labor laws;
- never use the Service to identify or retaliate against any employee based on their participation or feedback;
- inform your workforce that participation is voluntary and anonymous, and honor that anonymity; and
- be responsible for how you interpret and act on aggregated results within your organization.
7. Rewards
Where an employer enables survey rewards, eligible participants may receive a one-time-use reward or discount upon completing a survey. Rewards are subject to availability, have no cash value, are not transferable, and may be modified or withdrawn at any time. Rewards are distributed in a way that preserves anonymity and does not link a reward to a specific respondent’s feedback.
8. Intellectual property
The Service, including its software, design, branding, and content, is owned by Panda ECS LLC. and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
9. Third-party services
The Service runs on third-party infrastructure (including Google Firebase/Google Cloud, Vercel, Expo, and Resend). Your use of the Service may also be subject to the terms of the app store from which you obtained the app. We are not responsible for third-party services we do not control.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular feedback volume or outcome will be achieved.
11. Limitation of liability
To the fullest extent permitted by law, Panda ECS LLC. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or US $100.
12. Indemnification
If you use the Service on behalf of an organization, you agree to indemnify and hold harmless Panda ECS LLC. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your organization’s use of the Service or violation of these Terms.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or its users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and Panda ECS LLC. agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service. Before filing a claim, you agree to first contact us at privacy@tgifpanda.com to attempt to resolve the matter informally.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective” date above. If we make a material change, the app will ask you to review and acknowledge the updated Terms before you continue using the Service. Your continued use after an update means you accept the revised Terms.
